Do You Qualify?

You do not qualify for a work licence if:

  • you have an indefinite disqualification and have been ordered to attend an Assessment centre as a result of repeat offences involving alcohol and drugs.
  • you have been convicted of any two of the following types of offences committed in separate incidents within 5 years of each other:
    • Driving under the influence of alcohol or drugs (excluding youth alcohol level)
    • Reckless or dangerous driving
    • Careless driving causing injury or death
    • Failing to stop after an accident
    • Applying for or obtaining a licence whist disqualified from doing so

Further it is not possible to apply for a work licence:

  • for the purpose of conducting driving tests or acting as a driving instructor
  • for use in a passenger service (unless no more than 20 of the demerit points were accumulated while driving in a passenger service)
  • for use in a transport service, if you were disqualified for excess alcohol while operating transport service vehicle

Double check that you have put in the correct rego number/s of the vehicle you seek to drive. Also ensure that the vehicle/s you wish to drive from home to work and home again or just at work are currently registered and have a valid warrant of fitness. If they do not, your application will be seriously delayed.

As soon as I receive your online response to the questions my secretary will contact you and arrange for a telephone conference call with me at a time suitable to both of us.

How it works Nationwide (outside of Auckland)

  1. First check you are eligible for a limited licence. If in doubt call me (Melanie Coxon) on 021 911155.
  2. Next click the RED get started button. Take 10 minutes, answer the questions as fully as you can.
  3. When finished hit the submit button. My secretary will call you within 30 minutes and arrange a time for a telephone conference with me.
  4. Next I will email you my terms of engagement, my Bill of Costs for $600 plus GST and my instructing solicitor letter which you must sign and fax or acknowledge, accept then email back to me.
  5. During the subsequent telephone interview I will prepare a draft affidavit for you and your employer or accountant. It will take approximately 20 minutes. I pay for the phone call.
  6. Next I will email you the draft employer/accountant affidavit. You then arrange for your employer/accountant to amend their affidavit if necessary, have it sworn before a Justice of the Peace, lawyer or Court Registrar then have it scanned and emailed back to me at ok2drive@lawyerhelp.co.nz or faxed to 09 377 8454 asap. At the same time you or your employer need to put the original affidavit in the mail for my urgent attention - c/o Melanie Coxon, barrister PO BOX 91781 Auckland 1142.
  7. Once I receive the employer affidavit I fax it along with your draft affidavit and the draft order (containing the days and hours you need to drive) to your local police prosecutor for their consideration and hopefully prompt approval.
  8. You in return must agree to pay my $600+gst = $690 fee by on line banking or over the counter at your local Kiwibank (Post office) (Melanie Coxon, Kiwibank account number 389008 0453945 00) and pay my fee within 7 days of the date of the bill of costs. Prompt payment is part of the deal. I charge a low fee. If the police do not consent to your application or the judge refuses to grant the order despite police consent I will refund your fee.
  9. Once I have obtained police approval I will phone you then email your draft affidavit to you so that you can have it sworn before a Justice of the Peace, a lawyer or a District Court Registrar then returned to me by overnight courier post along with a money order for $153.33 made out to the Ministry of Justice. Alternatively I can pay your filing fee on condition you agree to deposit $153.33 to my Filing Fee bank account 389008 0453945 09 to reimburse me before the Court hearing date.
  10. Once I have your sworn affidavit and you have paid my fee I will immediately send your application along with the filing fee and a covering letter to the local District Court Registrar seeking an urgent hearing date for you. I will also inform the Registrar your application is unopposed and that you will be appearing on your own account.
  11. To ensure there are no slip ups I will phone the Registrar the next day and obtain the date of your Court hearing. I will then inform you and the police prosecutor of the date by email.
  12. At the same time I will put a free log book in the mail to you along with two notes. One note is addressed to THE REGISTRAR IN COURT on the day of your hearing and other note is addressed to THE POLICE PROSECUTOR IN COURT on the day. The NOTE advises each that you are appearing on your own behalf and that your application is unopposed.
  13. On the day of your Court hearing be at the Court House by 9:45am. Look on the posted Court list to see which Court room your matter is to be called in. Once in the Court room hand the note headed "TO REGISTRAR IN COURT" to the Registrar and the note headed "TO POLICE PROSECUTOR" to the Police prosecutor sitting at the front of the Court then go sit down and wait for your name to be called. When your name is called stand up, speak up and state your name (ie John Brown appearing on my own behalf in regards to a limited licence application which I understand is not opposed by the police)
  14. Once the Judge has granted the order you must go back to the Criminal Counter where the Deputy Registrar will advise you what time you can pick up your order (two copies). Before you can drive however you must take the orders to the local AA (Automobile Association) office pay the licence fee of $46 at which time you will be given your temporary licence.
  15. Make sure that you always carry your log book with you and that you fill it in each time you get into your vehicle. If you do not and you are stopped by the police for not complying with the terms of your limited licence order you will be charged with breaching the terms of your limited licence and face a further 6 months disqualification with no second chance of a limited licence.

Special Note: If the police oppose your application but you still wish to proceed to court on your own behalf to try and argue your case before the Judge or you engage a local lawyer to appear for you, you may use the documents I have prepared for you and keep the log book but I will charge you $250 +gst for my time preparing your application. This includes the actual Court application, your affidavit, your employer/accountant’s affidavit and the draft order containing the terms and conditions you are seeking.

The money back guarantee is subject to you providing me accurate information when you answer the website questions/and or during our telephone conference or in person interview. ie you must have no previous disqualifying offences within 5 years of the date of your current offence. The guarantee applies only if the judge fails to grant the application. It does not operate if for any reason you instruct me to stop or withdraw the application once I have prepared your affidavit and supporting papers and obtained police consent. ie you change your mind for any reason whatsoever.

A half fee refund is available if you have written confirmation from your employer that he has withdrawn his affidavit in support of your application and that you have lost your job before the actual court hearing but for no other reason.
